Metabolic Health MD, PLLC, a Texas professional limited liability company ("MHMD," "we," "us," or "our"), operates this website (the "Site").
MHMD has operated since June 2020 and has maintained privacy and security practices throughout. This Website Privacy Policy reflects our current online privacy practices as of the Effective Date.

Medical services are provided only to patients physically located in the United States at the time of service and only in states where MHMD clinicians are licensed. MHMD currently holds medical licenses in: TX, FL, CA, WA, OH, IA, TN, NJ, AZ, CO, AL, IL, IN, PA, WI, LA.


Medical Services Eligibility and Out-of-State / International Visitors: MHMD provides medical services (including diagnosis, treatment, prescribing, and ordering/interpreting clinical tests as part of medical care) only to individuals who are physically located in the United States at the time of service and in states where MHMD clinicians are licensed. If you are located outside a state where we are licensed (or outside the United States), we do not provide medical care and we do not establish a physician-patient relationship. In such cases, we may offer general health coaching and educational
wellness information that is not medical advice and is not a substitute for care from your local licensed clinician. We reserve the right to decline, cancel, or convert a request to non-medical coaching based on your location and eligibility.

2. Scope of This Policy​

This Website Privacy Policy describes how we collect, use, and share information collected through the Site and related online interactions (for example, contact forms and scheduling links).
If you become a patient, information that qualifies as Protected Health Information ("PHI") is governed
by our HIPAA Notice of Privacy Practices (the "HIPAA Notice"). This policy does not replace the HIPAA
Notice.

3. Children’s Privacy​

The Site is not intended for children under 13, and we do not knowingly collect personal information from children under 13.


4. Information We Collect
A) Information you provide

We may collect information you provide when you submit a contact form, request information, communicate with us, schedule a consultation, submit intake/registration information, or purchase services (payment details are processed by third-party payment processors). This may include name, email, phone number, address, and information you include in messages/forms.

B) Information collected automatically

We may collect IP address, device identifiers, browser type, pages viewed, time spent, referring page, and general website usage data, including cookie and similar technology data (see Section 5).


5. Cookies and Similar Technologies
We may use cookies and similar technologies to operate the Site, remember preferences, measure performance, and improve user experience. You can usually control cookies through your browser settings. Disabling cookies may affect Site functionality.


6. How We Use Information​

We may use information to respond to inquiries and provide support, schedule appointments and deliver requested services, send administrative messages (confirmations, updates, security notices), send marketing communications (you can opt out at any time), improve the Site and our services, prevent fraud, secure our systems, and comply with legal obligations.


7. How We Share Information

We do not sell your personal information. We may share information with service providers that help us run the Site/business (hosting, IT support, scheduling, communications, analytics, payment processing), legal/safety recipients when required by law or to protect rights, safety, and security, successors if we undergo a merger, acquisition, or asset sale, and others at your direction/with your consent.


8. Patient Platforms and Third Parties

When you use our patient-facing tools (for example, patient intake forms or supplement/lab ordering portals), those tools may have their own terms and privacy policies.


Scheduling (Pr e-Patient): We may use third-party scheduling tools (such as Calendly) to allow prospective clients to request a free discovery call. Information submitted through these tools before you become a patient may not be PHI. Please do not submit sensitive medical information in discovery-call scheduling fields.


MHMD may use vendors to support care delivery and operations, including: IntakeQ (EHR/intake/forms), Google Workspace / Google Meet for telehealth video encounters under a signed Business Associate Addendum where applicable, Fullscript for supplement recommendations and lab ordering/processing and results handling, and ScriptSure (integrated e-prescribing within IntakeQ).


9. Security
We use reasonable administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is 100% secure.


10. HIPAA and PHI
If you become a patient and we create/receive/maintain information about you related to healthcare services, that information may be PHI and is governed by HIPAA and our HIPAA Notice of Privacy Practices.

11. Retention
We retain information as long as reasonably necessary for the purposes described above and as required by law. Medical records are retained consistent with Texas requirements/guidance, typically at least 7 years from last treatment, and for minors until age 21 or 7 years from last treatment, whichever is longer.


12. Your Choices
Marketing emails: you can unsubscribe at any time using the link in our emails. Updating non-medical information: contact us to update or correct certain information.


13. International Visitors
The Site is operated from the United States. If you access the Site from outside the U.S., information you submit may be processed and stored in the U.S.


14. Changes to This Policy
We may update this policy from time to time. We will post updates on this page and update the "Last Updated" date.
